Acceptance of Terms
Following terms and conditions apply when You use the "Ellaaj" website available at URL: www.ellaaj.com operated by XYZ News Network Limited ("Website") or mobile application of brand name "ellaaj" available for download at Google Play Store, Apple App Store, Windows App Store ("Application") operated by XYZ News Network Limited or avail any Services offered by XYZ News Network Limited through the Website or Application.
By registering on, accessing, or using the Platform, you ("you", "User", or "Patient") agree to be bound by these Terms. If you do not agree to be bound by these Terms, you must not use the Platform.
1. Nature of Services
Ellaaj provides an online platform facilitating virtual doctor consultations ("Services") via scheduled video calls between licensed medical professionals and patients. Ellaaj does not offer emergency medical services and is not a substitute for physical or in-person medical care in all situations.
2. User Responsibilities
You agree to:
- Provide accurate, current, and complete information during registration and consultation.
- Be available at the scheduled time for video consultation.
- Ensure stable internet connectivity and functioning devices for the consultation.
3. Limitations of Use
You shall not:
- Use the Platform for unlawful, fraudulent, or abusive purposes.
- Impersonate another person or misrepresent your identity or health information.
- Record or disseminate consultations without prior written consent from Ellaaj and the consulting doctor.
4. Consultation Outcomes
Ellaaj facilitates consultations between patients and registered medical professionals but does not guarantee specific outcomes, diagnoses, or prescriptions. The clinical discretion rests solely with the consulting doctor.
5. Privacy Policy
All personal and health-related data is governed by our Privacy Policy, which complies with applicable data protection laws. By using the Platform, you consent to the collection, storage, and processing of your data in accordance with our Privacy Policy.
6. Refund Policy
Full refunds will be provided under the following circumstances, subject to verification:
Technical Failure
If the scheduled video consultation could not be conducted due to technical issues (e.g., poor internet connectivity) and the video call duration was less than 30 seconds.
Doctor Unavailability
If the assigned doctor is unable to attend the consultation or declines to proceed with the consultation.
Patient No-Show
If the patient was unavailable at the scheduled time, and an alternative slot is not requested or offered within 24 hours.
System Errors
In case of duplicate payments, transaction errors, or booking glitches resulting in missed or incomplete consultations.
Non-Refundable Scenarios
Refunds will not be issued for completed consultations, irrespective of the medical advice or outcome, unless covered under the above scenarios.
7. Refund Process
To initiate a refund, the user must contact Ellaaj customer support via email to lokendrareporter@gmail.com or call 98910-39200 within 48 hours of the scheduled consultation. All refund requests will be reviewed within 7 business days.
Approved refunds will be processed to the original method of payment within 7-10 business days of approval.
8. Limitation of Liability
To the maximum extent permitted by law, Ellaaj shall not be liable for any indirect, incidental, or consequential damages arising from the use of or inability to use the Services.
9. Modification of Terms
Ellaaj reserves the right to modify these Terms at any time. Changes will be effective upon posting on the Platform. Continued use of the Services following such changes constitutes your acceptance of the revised Terms.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan.
